- To access ARCHICONNECT’s web platform and services, you must register for an account by providing accurate and complete information. The registration information you provide must be accurate, complete, and current at all times.

- To create a professional account (“Professional”, or “Professionals”), you agree to provide your full name, mobile number, email address, university name, degree name, degree year, any institutional identity and/or submit a copy of your degree certificate (in a PDF, PNG or JPEG format) for verification purposes. You will also provide any other information required during the registration process.

- To create a general account, you agree to provide your full name, mobile number, email address, and any other information required during the registration process.

- It is forbidden to falsely impersonate or misrepresent an individual or identity.

- At times, your access to and use of the Site and our Services may experience interruptions due to various factors, including equipment malfunction, updates, maintenance, or repairs to the Site, among other reasons, whether within or beyond our control. ARCHICONNECT retains the right, at its sole discretion and without prior notice, to suspend or discontinue the availability of the site or any service, as well as remove any visual, audio, text based or any other form of content.

- ARCHICONNECT reserves the right to impose limitations on specific features and Services or restrict your access to parts or the entirety of the Site and Services without prior notification or liability.

- It is essential to note that the Site should not be utilized or relied upon for the storage of your visual, audio, text based or any other form of content. We strongly advise retaining your copies of all visual, audio, text based and any other form of Content posted on the Site.

- Subscription fees are non-refundable unless otherwise specified.

- ARCHICONNECT does not involve in the process of creating work orders between Professionals (such as Architects, Civil Engineers, etc.) and clients.

- Both professionals and clients are responsible for their work orders, communication and financial transactions. ARCHICONNECT is not responsible for any of these but might interfere and take legal actions if any of the party breaks any laws.

- If you are a Professional, you must only accept work orders for which you are qualified to perform based on your educational degree, certifications, and compliance with the laws of Bangladesh.

- Our platform will simply connect you with Professionals, and we are not liable for any financial transactions, disputes arising from work orders, or outcome of any projects placed through our platform.

- You acknowledge that ARCHICONNECT is not responsible for the outcome of any projects or transactions facilitated through our platform.

- You are responsible for maintaining the security of your account and password. You agree not to share your login credentials with anyone else.

- You are solely responsible for all activities resulting from the use of your password and conducted through your ARCHICONNECT account.

- You bear full responsibility for your interactions with other users of the Site, encompassing any communications conducted via ARCHICONNECT's messenger service. While ARCHICONNECT retains the right, it is not obligated to scrutinize disputes between you and other users. This encompasses the authority to examine messages exchanged through ARCHICONNECT's messenger service, prompted by reports received by ARCHICONNECT alleging violations of these Terms through the utilization of the messenger service. Such reports may pertain to alleged instances of harassment, indecency, or offensive messages. Additionally, in the event of any allegation against you or if you file a complaint against another user, we reserve the authority to read and inspect the message communications between or among the involved parties.

- You affirm and guarantee that you possess ownership or authorization from the owner to exercise all rights, including copyrights, pertaining to all visual, audio, text based and any other form of content you submit or upload to the Site. You are not in violation of, nor breaching, any agreements with third parties by submitting or uploading visual, audio, text based and any other form of content to ARCHICONNECT. The visual, audio, text based and any other form of content does not defame any individual, nor does it infringe upon the copyright, moral rights, publicity rights, privacy rights, or any other rights of any person. Moreover, it does not contravene any laws, judicial orders, or governmental regulations.

- By uploading visual, audio, text based and any other form of content, you confirm that you own the rights to it and have the authority to grant ARCHICONNECT the necessary permissions. You also ensure that the content doesn't violate any laws or agreements.

- ARCHICONNECT is committed to upholding the intellectual property rights of individuals. We take allegations of copyright or other intellectual property infringement ("Infringement") seriously and will promptly address any such claims regarding any types of content posted on our Site.

- Upon receiving a notice of alleged Infringement, ARCHICONNECT will diligently investigate the matter and take appropriate action in accordance with applicable intellectual property laws and our Terms. This may include removing or disabling access to the content claimed to be infringing and/or terminating accounts and access to the Site.

- To report a possible Infringement, please submit a written notice to ARCHICONNECT's attention, designated as "Copyright Infringement," at info@archiconnect.homes. Your notice should include a detailed description of the alleged Infringement to facilitate our assessment. Please be aware that misrepresenting that Content infringes your copyright may result in legal consequences, including liability for damages and legal fees.

- If ARCHICONNECT removes or disables access to content based on an Infringement notice, we will make reasonable efforts to inform the user who posted the affected content. Should you believe that your content is not infringing, you may submit a counter notice in writing with the subject "Copyright Infringement Counter Notification" at info@archiconnect.homes. Your counter notice must provide sufficient information for us to evaluate the situation. However, please note that making false statements in your counter notice may lead to liability for damages, including costs and attorneys' fees, if it is determined that your content indeed infringes the copyrights of others.

- You agree to comply with all applicable laws and regulations in Bangladesh regarding your use of ARCHICONNECT. These Terms shall be governed by and construed in accordance with the laws of Bangladesh.

- You are solely responsible for any content (visual, audio, text based and any other form of content) you upload, submit, or transmit through ARCHICONNECT.

- You agree not to use our platform to transmit any unlawful, infringing, defamatory, or otherwise objectionable content.

A. Engaging in scraping and utilizing any automated system, such as "robots," "spiders," or "offline readers," to access ARCHICONNECT in a manner that generates more request messages to ARCHICONNECT servers than a human can reasonably produce in the same timeframe using a standard web browser.

B. You agree that you will not bypass any measures we may use to prevent or restrict access to the Site.

Since ARCHICONNECT lacks control over these external sites and resources, you understand and accept that ARCHICONNECT bears no responsibility for their availability. Additionally, ARCHICONNECT does not endorse nor assume liability for any content, advertisements, products, or other materials found on or accessible from such sites or resources.

- You also acknowledge and agree that ARCHICONNECT is not directly or indirectly liable for any damages or losses arising from, or alleged to arise from, the use of or reliance on any content, goods, or services available on or through any linked site or resource.

- If the Services or Site are utilized in a manner that violates the Terms in any manner, ARCHICONNECT may, at its sole discretion, choose to suspend or terminate your account, deactivate your access to the Site, and take any other actions it deems appropriate to address the situation.

- We reserve the right to suspend or terminate your account at any time for any other reason deemed appropriate by ARCHICONNECT.

- Upon termination of your account, your access to the services will cease immediately.

- We reserve the right to update these Terms periodically. Any revisions will take effect immediately upon being posted on our website. Your ongoing use of ARCHICONNECT indicates your acceptance of these updated Terms.

- ARCHICONNECT shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with your use of our platform.

- ARCHICONNECT denies all responsibility for any loss, injury, claim, liability, or damage of any kind resulting from or related to

A. Any errors or omissions on this site and the services, including technical inaccuracies and typographical errors.

D. The unavailability of all or any part of the site or the services.

- In cases where the above limitation of liability or Terms is not permitted by law or does not fulfill its fundamental purpose, ARCHICONNECT's sole obligation to you for damages will be limited to 1000 BDT.

- The party that prevails in a legal dispute shall be entitled to recover reasonable legal costs related to the aspect of its claim or defense on which it succeeded. Any awards for costs against the prevailing party shall be balanced against each other.

- Both parties agree that, regardless of any applicable statute(s) of limitation, any arbitration proceedings must be initiated within three months from the acts, events, or incidents that give rise to the claim.

Both you (any kind of account holder in ARCHICONNECT) and ARCHICONNECT consent that any dispute between you will only be resolved or litigated individually. You are prohibited from initiating a dispute as a class action, representative action, collective action, private attorney-general action, or in any proceeding where you act or intend to act on behalf of others. Furthermore, you acknowledge that no proceeding will be amalgamated with another without the prior written consent of ARCHICONNECT and all parties involved in those proceedings.

These Terms represent the complete understanding between all parties involved, replacing any previous written or verbal agreements concerning the subject matter discussed here. Any rule of construction stating that ambiguities are to be resolved against the drafting party will not be applied in the construction or interpretation of these Terms. That means, ambiguities in these Terms won't automatically be interpreted against the party who wrote them.

If any part of these Terms is found to be invalid, illegal, or unenforceable, it won't affect the validity, legality, or enforceability of the other parts. If there are any differences between these Terms written in English and versions in other languages, the English version will be considered authoritative to the fullest extent allowed by law.

If one party fails to enforce these Terms or overlooks a breach by the other party, it doesn't mean they're waiving their right to enforce the Terms in the future or in other situations. Each situation will be handled independently.
